These Terms of Service ("Terms") govern your access to and use of websites, digital services, patient-facing applications, scheduling tools, communications features, and other services made available by Nureli Medical Group, PLLC ("Nureli," "we," "us," or "our") that link to these Terms.
Please read these Terms carefully. By accessing or using services subject to these Terms, you agree to these Terms. If you do not agree, do not use those services.
1. About Nureli
Nureli Medical Group, PLLC is a healthcare practice that provides psychiatric care, including through telehealth, where its clinicians are authorized to provide care.
Availability of services may depend on your location, the availability and licensure of clinicians, insurance participation, clinical appropriateness, and other legal or operational requirements.
Nureli does not currently offer psychotherapy as a Nureli service. Where appropriate, a Nureli provider may recommend or refer a patient to psychotherapy or other services offered by others.
2. These Terms and Your Healthcare
These Terms govern use of Nureli's websites, digital services and related technology.
They do not replace the professional obligations of a licensed healthcare professional, informed consent for treatment, telehealth consent, our Notice of Privacy Practices, or other notices, authorizations or agreements that may apply to your healthcare.
Nothing in these Terms is intended to limit rights that cannot lawfully be limited or waived.
3. When a Patient-Provider Relationship Begins
Using Nureli's public website, creating an account, completing a questionnaire, requesting an appointment, checking insurance information, viewing a provider profile, or communicating with Nureli for administrative purposes does not by itself establish a patient-provider relationship with a particular clinician.
A patient-provider relationship is established only when required clinical and legal prerequisites have been satisfied and a Nureli clinician begins providing professional healthcare services to you in accordance with applicable law.
The availability of a clinician or appointment does not guarantee that a particular treatment, medication, diagnosis or other clinical service will be appropriate for you.
4. Not for Emergencies
Nureli's websites, applications, messaging tools and routine clinical services are not emergency services and should not be used for medical or psychiatric emergencies.
If you believe you are experiencing an emergency, call 911 or go to the nearest emergency department. If you or someone else is experiencing a mental health or suicide crisis in the United States, you may also call or text 988 to reach the 988 Suicide & Crisis Lifeline.
Do not rely on messages sent through Nureli's website, patient application, email, text messaging or other non-emergency communication channels for urgent or emergency assistance.
5. Eligibility and Location
You may use Nureli services only when doing so is lawful and when Nureli is authorized to make the applicable service available to you.
Healthcare availability may depend on your physical location at the time care is provided. You may be asked to confirm your location before or during a telehealth visit.
You agree to provide accurate information concerning your identity, location and eligibility to receive services.
Nureli may decline or discontinue access to a service where legal, licensing, clinical, payer or operational requirements are not satisfied.
6. Telehealth Services
Nureli may provide healthcare through telehealth technologies, including video, telephone and secure electronic communications.
Telehealth has benefits and limitations. Technology may fail, communications may be interrupted, and telehealth may not be clinically appropriate in every situation.
When required, Nureli will provide a separate telehealth informed-consent process. Acceptance of these Terms is not a substitute for any telehealth consent required by law or Nureli policy.
You are responsible for providing accurate information about your physical location during a telehealth encounter and for participating from an environment that allows you to communicate safely and appropriately with your provider.
7. Accounts
Some Nureli services may require an account.
You agree to provide accurate, current and complete information and to keep relevant account information reasonably current.
You are responsible for maintaining the confidentiality of your authentication credentials and for taking reasonable steps to prevent unauthorized use of your account.
Do not share authentication credentials with another person.
Notify Nureli promptly if you believe your account has been accessed or used without authorization.
Nureli may use identity verification, authentication, security monitoring and other safeguards to protect accounts and information.
8. Information You Provide
You agree to provide information that is accurate to the best of your knowledge when using Nureli services.
Healthcare decisions may depend on information you provide, including information about your symptoms, health history, medications, allergies, pharmacy, location, insurance coverage and other relevant circumstances.
You should promptly tell your healthcare provider about material changes that may affect your care.
9. Scheduling and Appointments
Nureli may allow you to request, schedule, reschedule or cancel appointments electronically.
An appointment is not guaranteed merely because a time appears available. Availability may change, and an appointment is confirmed only when Nureli's scheduling system confirms it.
Nureli may impose reasonable scheduling requirements, including advance-notice requirements, booking windows and cancellation rules.
Applicable cancellation, late-cancellation, missed-appointment or other scheduling policies will be disclosed separately where relevant.
Nureli may need to reschedule or cancel an appointment because of clinician availability, emergencies, technical problems, licensing restrictions or other operational or clinical circumstances.
10. Insurance
Nureli may provide tools or services to help determine whether an insurance plan appears to be accepted or whether benefits appear available.
Insurance information and eligibility responses are not guarantees of payment or coverage.
Health plans determine benefits, eligibility, medical necessity, cost-sharing and payment according to the applicable plan.
You are responsible for providing accurate and current insurance information.
You remain responsible for amounts you owe under applicable financial policies and agreements, subject to applicable law and your health plan.
11. Self-Pay and Payments
Some services may be available on a self-pay basis.
Prices, payment obligations, refund rules and other financial terms applicable to a service will be disclosed separately where appropriate.
Payment processing may be performed by third-party payment processors.
Nureli does not store full payment card numbers on its own systems.
Nothing in these Terms authorizes a charge that has not otherwise been properly disclosed or authorized.
12. Prescriptions and Treatment Decisions
Clinical decisions are made by licensed healthcare professionals based on their professional judgment and the information available to them.
Using Nureli does not guarantee:
- a diagnosis;
- a prescription;
- a particular medication;
- a medication refill;
- laboratory testing;
- a referral;
- a particular treatment plan;
- continuation of a previous treatment.
A clinician may determine that a requested medication or treatment is not clinically appropriate or cannot lawfully be provided through Nureli.
Prescriptions, when clinically appropriate, may be transmitted electronically to a pharmacy selected or approved by the patient.
Pharmacies are independent organizations and may have their own policies, inventory limitations, pricing and processing requirements.
13. Controlled Substances
Nureli's prescribing practices are determined by applicable law, professional standards, clinical judgment and Nureli policy.
Availability of any medication should not be assumed based on website content, scheduling availability or prior treatment received elsewhere.
A Nureli clinician is never required to prescribe a medication requested by a patient.
Where Nureli policy does not permit a particular category of prescribing, the availability of a consultation does not override that policy.
14. Laboratory and Other Clinical Services
A Nureli clinician may recommend laboratory testing or other services when clinically appropriate.
Laboratories, pharmacies and other outside healthcare organizations may be independent from Nureli and may impose their own charges, policies and requirements.
Nureli is not responsible for the independent acts or omissions of third-party healthcare organizations, except to the extent responsibility cannot lawfully be excluded.
15. Communications
Nureli may communicate with you through email, telephone, text message, secure messaging, patient applications or other channels you provide or authorize.
Some communications are necessary to administer your account, provide healthcare, communicate about appointments, address security matters, provide legally required notices or operate Nureli services.
Electronic communications can involve privacy and security risks.
You are responsible for keeping your contact information current and for considering who may have access to devices, telephone numbers, email accounts or other communication channels you provide.
Additional consent may be requested for particular categories of communications where required.
16. Electronic Records and Signatures
Nureli may provide records, notices, acknowledgments, consents and other documents electronically where permitted by law.
Electronic signatures and electronic acknowledgments may have the same legal effect as their paper equivalents where applicable law provides.
Certain documents may require separate affirmative acceptance or acknowledgment.
Acceptance of these Terms does not constitute acceptance of a separate document unless Nureli clearly presents that document and indicates that your acceptance applies to it.
17. Privacy
Nureli's Privacy Policy explains how personal information is collected, used and disclosed in connection with Nureli services.
Nureli's Notice of Privacy Practices explains how Nureli may use and disclose protected health information under HIPAA and describes patient rights concerning protected health information.
Where information is protected health information governed by HIPAA, the Notice of Privacy Practices governs Nureli's handling of that information.
A website cookie or privacy preference is not a HIPAA authorization.
18. Third-Party Services
Nureli may use or link to third-party services involved in areas such as telehealth, pharmacies, laboratories, payment processing, insurance eligibility, communications, electronic signatures, identity services and other healthcare or operational functions.
Some third-party services may be governed by their own terms or privacy practices.
A link to or integration with a third-party service does not necessarily mean Nureli controls that service.
Nothing in this section limits responsibilities Nureli has under applicable healthcare, privacy or other law for vendors or business associates acting on Nureli's behalf.
19. Acceptable Use
You may not misuse Nureli's websites, applications or services.
You agree not to:
- attempt to gain unauthorized access to accounts, systems or information;
- interfere with the security or operation of Nureli systems;
- introduce malicious code;
- impersonate another person;
- use another person's account without authorization;
- submit information you know to be materially false for fraudulent purposes;
- scrape, harvest or systematically extract protected or proprietary information without authorization;
- use Nureli services to violate applicable law;
- threaten, harass or abuse Nureli workforce members, clinicians or other users.
Nothing in this section prohibits good-faith complaints, disputes, requests for records, reports of safety or privacy concerns, or other lawful exercise of patient or consumer rights.
20. Intellectual Property
Nureli's websites, software interfaces, branding, graphics, text and other content may be protected by copyright, trademark and other intellectual property laws.
Subject to these Terms, Nureli grants you a limited, personal, non-exclusive, non-transferable and revocable right to use Nureli's patient-facing services for their intended purposes.
This does not transfer ownership of Nureli intellectual property to you.
Your medical records and rights concerning information about you are governed by applicable law and are not converted into Nureli intellectual property by this section.
21. Service Availability and Changes
Nureli may modify, maintain, suspend or discontinue digital features from time to time.
We do not guarantee that every website or digital feature will operate without interruption or error.
Maintenance, outages, third-party failures, security events or other circumstances may temporarily affect availability.
Where interruption of a digital feature affects ongoing patient care, Nureli will address continuity and access consistent with applicable professional and legal obligations.
22. Suspension or Termination of Digital Access
Nureli may restrict or suspend access to an account or digital service when reasonably necessary for security, suspected misuse, legal compliance or protection of Nureli systems or users.
Suspension of digital access does not eliminate rights a patient may have to obtain medical records or otherwise exercise rights under applicable law.
Ending access to a digital service is not necessarily the same as terminating a patient-provider relationship.
Any termination of an established clinical relationship will be handled according to applicable professional and legal requirements.
23. Educational Information
General information made available through Nureli's public website or educational materials is provided for informational purposes.
General educational content is not individualized medical advice and should not be used as a substitute for evaluation by a qualified healthcare professional.
Personalized medical advice is provided only through an appropriate clinical relationship.
24. No Guarantee of Results
Healthcare outcomes vary from person to person.
Nureli and its clinicians do not guarantee a particular clinical result, diagnosis, medication response or outcome.
Nothing in this section reduces the professional standard of care or other duties imposed on healthcare professionals by applicable law.
25. Disclaimer Regarding Digital Services
To the extent permitted by law, Nureli's non-clinical digital services are provided on an "as available" basis.
Nureli does not guarantee that digital services will always be uninterrupted, error-free or compatible with every device or network.
This section does not disclaim or limit professional duties owed by healthcare professionals, obligations concerning protected health information, or rights that cannot lawfully be waived.
26. Limitation of Liability
To the extent permitted by applicable law, Nureli will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from use of or inability to use non-clinical website or digital functionality.
This limitation does not apply where liability cannot lawfully be limited and is not intended to waive or limit rights or remedies arising from professional healthcare services, medical malpractice, gross negligence, willful misconduct, violations of applicable privacy law, or other matters for which liability may not lawfully be excluded or limited.
27. Your Responsibility for Misuse
To the extent permitted by law, you are responsible for losses resulting from your unlawful or unauthorized misuse of Nureli services or your material violation of these Terms.
This provision does not require you to indemnify Nureli for Nureli's own professional negligence, unlawful conduct or other responsibility that cannot lawfully be shifted to you.
28. Governing Law
These Terms are governed by applicable federal law and, except where another jurisdiction's law is required to apply, the laws of the State of Texas, without regard to conflict-of-law principles.
Healthcare services remain subject to the laws and professional requirements applicable to the jurisdiction in which care is provided.
Nothing in this section eliminates rights or protections that applicable law requires to remain available to you.
29. Disputes
If you have a concern about Nureli's digital services, you may contact us so that we can attempt to address it.
Nothing in these Terms prevents you from:
- filing a complaint with a governmental or regulatory agency;
- exercising rights under HIPAA or other privacy law;
- making a complaint to a professional licensing authority;
- reporting a safety concern;
- exercising any right that cannot lawfully be restricted.
These Terms do not require arbitration and do not waive a right to a jury trial.
30. Changes to These Terms
Nureli may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date and version identifier.
Where required by law or where changes materially affect your rights or obligations, we will provide additional notice or obtain renewed acceptance as appropriate.
Continued availability of an older version does not mean that version continues to govern new use after a valid updated version takes effect.
31. Relationship to Other Agreements and Notices
These Terms should be read together with other documents that apply to your use of Nureli services.
Those documents may include:
- Privacy Policy;
- Notice of Privacy Practices;
- telehealth informed consent;
- consent to treatment;
- financial policies;
- communication consents;
- insurance-related authorizations;
- other clinical or state-specific notices and consents.
If these Terms conflict with a document that specifically governs protected health information, clinical care or a particular transaction, the more specific applicable document controls for that subject.
32. Severability
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
33. No Waiver
If Nureli does not immediately enforce a provision of these Terms, that does not waive Nureli's right to enforce it later.
